YOU MUST BE AN ADULT AND AN AUTHORIZED USER OF THE PAYMENT METHOD USED TO CREATE A SUPER STAR CAR WASH MEMBERSHIP. THESE TERMS INCLUDE A REQUIREMENT FOR YOU AND SUPER STAR CAR WASH TO RESOLVE ANY DISPUTES IN BINDING, INDIVIDUAL ARBITRATION. THIS MEANS YOU ARE GIVING UP THE RIGHT TO GO TO COURT AND TO HAVE A JUDGE OR JURY DECIDE THE DISPUTE. SEE THE “DISPUTE RESOLUTION” SECTION BELOW FOR MORE DETAILS. THESE TERMS, INCLUDING THE DISPUTE RESOLUTION REQUIREMENTS, WILL APPLY NOT JUST TO YOU, BUT ALSO TO ANY PERSON YOU AUTHORIZE TO DRIVE YOUR CAR AND USE YOUR SUPER STAR CAR WASH MEMBERSHIP.
Automatic Renewal of Memberships
BY SIGNING UP FOR A MEMBERSHIP PLAN, YOU ARE AUTHORIZING SUPER STAR CAR WASH TO CHARGE THE MEMBERSHIP FEE TO YOUR PAYMENT METHOD EACH MONTH UNTIL YOUR MEMBERSHIP IS CANCELLED.
Super Star Car Wash offers car wash plans that allow customers to subscribe to a “membership” plan specifying a car wash level or type at any Super Star Car Wash location within the United States. The recurring monthly fee depends on the membership plan purchased for each, individual vehicle.
In order to process your membership request, Super Star Car Wash will need to collect personally identifying information, which is subject to our Privacy Policy. It is important that you review that policy to understand what information we collect and what we do with that information.
By signing up for a membership plan, you are authorizing Super Star Car Wash to charge your credit/debit card monthly for the amount of your chosen membership plan. YOUR MEMBERSHIP WILL RENEW MONTHLY UNTIL CANCELLED. THE MONTHLY BILLING DATE WILL BE THE SAME DAY THE MEMBERSHIP IS PURCHASED. YOUR CREDIT/DEBIT CARD WILL BE CHARGED ON THE BILLING DATE FOR EACH MONTH DURING THE DURATION OF YOUR MEMBERSHIP. SUPER STAR CAR WASH MEMBERSHIP PLAN OR WASH LEVEL NAMES, RECURRING PRICES, FEATURES, OR INGREDIENTS ARE SUBJECT TO CHANGE.
YOU MAY CANCEL YOUR MEMBERSHIP AT ANY TIME BY VISITING HTTPS://WWW.SUPERSTARCARWASHAZ.COM AND CLICKING “CANCEL MEMBERSHIP” UNDER THE “MEMBERSHIPS” MENU, OR BY MAILING A CANCELLATION REQUEST TO 960 W BEHREND DRIVE, SUITE 1, PHOENIX, AZ 85027. IF YOU CANCEL YOUR MEMBERSHIP LESS THAN SEVEN (7) DAYS BEFORE YOUR NEXT BILLING DATE, YOU MAY BE CHARGED FOR THE NEXT SUBSEQUENT MONTH. Paid membership fees are non-refundable and there are no refunds or credits for partially used membership plan periods.
Super Star Car Wash may, at its sole discretion, cancel your membership plan at any time due to violations of these Terms and Conditions, failure to pay (e.g. credit/debit card declined by payment processing system), acts of abuse toward our employees, customers or others, vandalism, theft of Super Star Car Wash supplies or property, illegal or fraudulent use of your membership, or other circumstances as deemed appropriate by Super Star Car Wash.
Text Messagse
You agree that Super Star Car Wash (and others on its behalf) may send you automated text messages at the mobile number you provided (and any other number you provide). You further agree that such communications may include, without limitation, communications about appointments, purchases, services, balances, and debts. You further agree that such messages may be sent using equipment that automatically selects and/or dials numbers.
You acknowledge that message and data rates may apply to such communications, and You agree that Your consent to these communications is a material term of this Agreement that You cannot unilaterally modify or revoke. See our Mobile Terms of Service.
Emails
You agree to receive emails from Super Star Car Wash at the email address you provided (and any other email address you provide), including emails about appointments, purchases, services, balances, debts, and promotional marketing. You can unsubscribe from promotional emails at any time by using the unsubscribe link in the email.
Your membership plan cannot be combined with any other programs or discounts including, but not limited to corporate accounts, prepaid wash passes, loyalty rewards, and/or other coupons or discounts.
Super Star Car Wash may affix or request that you affix a Super Star Car Wash provided radio frequency identification (RFID) sticker to the interior of your vehicle’s front windshield upon enrollment in a membership plan. This RFID sticker is unique to your vehicle and must be properly affixed each time you visit a Super Star Car Wash location for services. We also may use License Plate Reader technology to verify your active membership. Only the vehicle listed during your membership enrollment process is eligible for your selected membership plan and only that vehicle is authorized to display, present or use the supplied RFID sticker or other identifying mechanisms. Your membership plan is not transferrable upon the sale, donation, or other change of ownership to your vehicle. Any change in ownership must be reported to Super Star Car Wash. Your membership plan may be transferred between vehicles in the event the vehicle associated with the membership is sold/donated and a replacement vehicle has been purchased. Damaged, lost, or stolen tags must be reported to Super Star Car Wash immediately by contacting us at https://www.superstarcarwashaz.com/contact . Attempting to remove the RFID tag will destroy it and prevent it from operating correctly. Super Star Car Wash reserves the right to charge an additional fee for RFID tag replacement.
Super Star Car Wash is not responsible for damage to or the repair of:
- Loose equipment, including but not limited to, mirrors, trim, molding, emblems, light covers, wheel covers, center caps, bumpers, running boards, flaps, or bug deflectors that become dislodged during contact with Super Star Car Wash equipment;
- Any “rack” devices such as luggage racks, bicycle racks, or work racks;
- Pre-existing conditions with your vehicle or any after-market parts or installations;
- Vehicles with less than five inches (5”) of ground clearance or vehicles that are greater than seven-feet, two-inches (7’ 2”) in height;
- Vehicles that are wider than seventy-three inches (73”) in total width as measured from tire wall to tire wall or have tires that exceed thirteen inches (13”) in width;
- Vehicles that are five (5) years old or older;
- Water leakage resulting from unsecured or open doors or windows including sunroofs, trucks, and hoods;
- Antennas that are not fully removed, lowered or otherwise secured by you including power antennas, whip antennas, antenna fins, or other antennas that otherwise cannot be lowered or removed;
- Collisions due to braking in while vehicles are in the tunnel or incidents that occurred while you or other customers are operating vehicles;
- Any automated system or feature on your vehicle that may cause damage to your vehicle or other vehicles.
If you believe the damage has occurred to your vehicle, you must notify the manager on duty and file a claim BEFORE the vehicle leaves the premises. Super Star Car Wash will process that claim within fourteen (14) calendar days and contact you with the results of its investigation. If it has been confirmed that damage has occurred, you agree to obtain a minimum of two (2) estimates for repair with one (1) estimate from a repair shop of Super Star Car Wash’s choice. Any work must be approved by Super Star Car Wash PRIOR to any work being started.
Dispute Resolution
Most disputes can be resolved informally if you speak to a manager on duty or write to Super Star Car Wash at [email protected]. If we cannot resolve a dispute informally, disputes of any kind or nature between Super Star Car Wash on the one hand, and you or anyone you authorize to drive your enrolled vehicle and use your Super Star Car Wash membership on the other, will be resolved by a single arbitrator in binding, private, individual arbitration governed by the Federal Arbitration Act, 9 U.S.C. § 1, et seq., and conducted by National Arbitration and Mediation (“NAM”), https://namadr.com, according to NAM’s Comprehensive Dispute Resolution Rules and Procedures (the “Rules”), as modified by these Terms. Arbitration is an alternative dispute resolution process in which the parties agree to have their disputes decided by a neutral third party, called an “arbitrator,” and not by a judge or jury. Arbitration follows different procedural rules than a court would and may involve significantly narrower pretrial discovery than in court, and the arbitrator’s binding decision is subject to very limited review by courts. Instructions on how to file a claim in arbitration can be found on NAM’s website or by emailing NAM at commercial.namadr.com. The only exception to this arbitration requirement is that either of us may alternatively pursue a claim in a small claims court with jurisdiction to hear the dispute. The arbitrator shall decide all issues in dispute between us, including any disputes we have over the scope, validity, and enforceability of this requirement to arbitrate.
You and Super Star Car Wash agree that each of us may arbitrate a dispute against the other only on individual basis even if the arbitration provider may allow disputes to be arbitrated on a class or representative basis. The arbitrator shall have the power to award any type of relief that would be available to satisfy your individual claim in a court of competent jurisdiction, but to the fullest extent allowed by applicable law, the arbitrator may not award relief for the benefit of any person other than the claimant. The arbitrator shall issue a written decision (called an “Award”), which will be final and binding upon the parties.
For disputes in which the claimant seeks less than USD $10,000, the arbitrator will decide the matter solely on the basis of written submissions, without a formal hearing, unless the arbitrator decides that a formal hearing is necessary. For matters in which the claimant seeks USD $10,000 or more, or smaller matters in which the arbitrator determines a hearing to be necessary, hearings shall be conducted by video or telephone, unless on a showing of good cause the arbitrator determines an in-person hearing to be necessary, in which case the location of a hearing shall be determined according to the Rules.
To the fullest extent permitted by applicable law, the claimant must start arbitration of a dispute within one (1) year from when the dispute first arose. Failure to start an arbitration within that one-year period may bar the claim forever.
If 25 or more disputes are filed contemporaneously with NAM raising similar claims, these will be considered “Mass Arbitration Cases” and will be treated as mass filings or multiple case filings according to the Rules. Super Star Car Wash or you may advise the other of its or your belief that cases are Mass Arbitration Cases, and disputes over whether a case or cases meet the contractual definition of “Mass Arbitration Cases” will be decided by NAM as an administrative matter.
Applicable statutes of limitations will be tolled for all disputes asserted in a demand for arbitration, but only cases chosen for bellwether treatment according to the process below shall be deemed filed by NAM and NAM shall only charge fees associated with cases chosen for bellwether treatment (along with any fees necessitated by the disputes NAM resolves as a process or administrative matter). Remaining cases shall be treated by NAM and the parties as though they had not been filed.
Counsel involved in Mass Arbitration Cases shall confer in good faith once those disputes have been filed in arbitration regarding the number of cases that should proceed in arbitration as bellwethers. If the parties do not agree on the number of bellwethers, an even number of cases shall be chosen by NAM as an administrative matter (or, in the arbitration provider’s discretion, by a process arbitrator, taking into account the complexity of the dispute, differences in facts or applicable laws among various cases, the extent to which counsel for claimants are the same or coordinated, and the arbitration provider’s ability to try bellwether cases simultaneously if each case is assigned to a different arbitrator. Once the number of bellwethers is fixed, by agreement or by the arbitration provider, each side shall select half that number from among the claimants, and only those chosen cases shall be deemed by NAM to have been validly filed and subject to the assessment of arbitration fees. If both sides do not or cannot identify the bellwether cases to be tried, the arbitration provider will choose cases at random. You acknowledge understanding that, if your dispute is or becomes a Mass Arbitration Case and is not selected as a bellwether, this bellwether process may delay the resolution of your dispute. A single arbitrator shall preside over each Mass Arbitration Case chosen for a bellwether proceeding, and only one Mass Arbitration Case may be assigned to each arbitrator as part of a bellwether process, unless the parties agree otherwise.
No later than 60 days after all bellwether trials have concluded, the parties must schedule a mediation of all remaining Mass Arbitration Cases. If the parties do not agree on a mediator, the arbitration provider will appoint a mediator as an administrative matter. If the mediation does not yield a global resolution, this arbitration requirement shall no longer apply to remaining Mass Arbitration Cases. If a formerly arbitrable Claim is brought in court, the claimant asserting such a Claim may seek class treatment, but to the fullest extent allowed by applicable law, the classes sought may comprise only the claimants in the Mass Arbitration Cases whose disputes were not resolved during the bellwether process. Any party may contest class certification at any stage of the litigation and on any available basis.
A court shall have authority to enforce this bellwether process for Mass Arbitration Cases and may enjoin the filing of lawsuits or arbitration demands not made in compliance with it.
To the maximum extent permitted by applicable law, for any case deemed not subject to the requirement to arbitrate (except to the limited extent discussed above for Mass Arbitration Cases), you and Super Star Car Wash will only bring disputes, claims, or controversies between you and Riot Games in an individual capacity and shall not:
- seek to bring, join, or participate in any class, collective, or representative action, or any other action where another individual or entity acts in a representative capacity (like private attorney general actions); or
- consolidate or combine individual proceedings or permit another to do so without the express consent of all parties.
Super Star Car Wash may, from time to time, update, alter, change, or modify these Terms and Conditions without notification. It is your responsibility to check for and comply with such adjustments. Super Star Car Wash may not alter the terms to arbitrate a dispute once the dispute has arisen.
